General Terms and Conditions (GTC)

These General Terms and Conditions ("GTC") govern the use of the website https://banded-berlin.com (the "Service"), operated by Gebel Hibbs GbR ("we", "us", or "our").

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to provide certain information relevant to your Purchase, including your payment information, billing address, and shipping information.

You represent and warrant that:

Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer to conclude a purchase contract, but an invitation for the customer to place an order.

By submitting the order, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

The order or receipt confirmation sent automatically immediately after receipt of the order solely confirms that the order has been received by us. It does not constitute acceptance of the customer's offer and does not yet lead to the conclusion of a purchase contract.

We reserve the right to suspend or delete a customer account if there is a justified suspicion of abuse, fraud, unauthorized use, or a material breach of these GTC.

The Service and its original content, features, designs, product presentations, text, graphics, and layout are and remain the exclusive property of Gebel Hibbs GbR or its respective rights holders.

The Service is protected by copyright, trademark, and other applicable legal proprietary rights of Germany and other countries.

The legal rights and claims of the parties remain unaffected by this.

If you wish to terminate your account, you may simply discontinue using the Service or contact us regarding the deletion of your customer account.

These GTC and the contractual relationships between us and our customers are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention, unless mandatory consumer protection regulations provide otherwise.

If you are a consumer and have your habitual residence in another member state of the European Union, the mandatory consumer protection provisions of that state remain unaffected.

Should an individual provision of these GTC be or become ineffective or unenforceable, the remaining provisions shall remain unaffected.

Changes to These GTC

We reserve the right to amend these GTC with effect for future orders, particularly if changes in legal requirements, our business processes, or the services offered make this necessary.

For contracts already concluded, the terms and conditions agreed upon at the time of the conclusion of the contract shall generally apply.
